DMCA Policy
InsuranceIntel.us ("we", "our", or "us") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the InsuranceIntel.us website (the "Site") if such claims are reported to our Designated Copyright Agent identified in the sample notice below.
If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.
1. DMCA Notice of Alleged Infringement ("Notice")
Upon receipt of Notice as described below, InsuranceIntel.us will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site. To file a notice of infringing material, please provide a notification containing the following details:
- Identification of the Copyrighted Work: Provide a detailed description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by this Notice, you may provide a representative list of the copyrighted works that you claim have been infringed.
- Identification of the Infringing Material: Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material, including at a minimum, if applicable, the URL of the link shown on the Site where such material may be found.
- Contact Information: Provide your mailing address, telephone number, and, if available, an email address.
- Statement of Good Faith: Include a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement of Accuracy: Include a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Signature: Provide your physical or electronic signature.
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages (including costs and attorneys' fees). If you are unsure whether the material available online infringes your copyright, we suggest that you contact an attorney before sending us a notice.
2. Counter-Notification Procedures
If you believe that material you posted on the Site was removed or access to it was disabled by mistake or misidentification, you may file a Counter-Notification with us (a "Counter-Notice"). Pursuant to the DMCA, the Counter-Notice must include substantially the following:
- Your physical or electronic signature.
- An identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.
- Adequate contact information (including your name, postal address, telephone number, and, if available, email address).
- A statement under penalty of perjury by you that you have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.
- A statement that you will consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you reside outside the United States for any judicial district in which the Site may be found) and that you will accept service from the person (or an agent of that person) who provided the Site with the complaint at issue.
3. Repeat Infringers
It is our policy in appropriate circumstances to disable and/or terminate the accounts of users who are repeat infringers. InsuranceIntel.us reserves the right to define "repeat infringer" based on the circumstances of the claims, but generally, this includes users who have been the subject of multiple valid DMCA notices.
4. AI & Calculator Tools Disclaimer
InsuranceIntel.us utilizes original algorithms and AI tools for its calculators. However, certain data inputs or outputs may reference publicly available insurance data. We claim copyright ownership over the specific code, layout, and methodology of our tools. Any unauthorized scraping, framing, or duplication of our calculator tools is a violation of our intellectual property and will be met with a DMCA takedown notice.
5. Modification of Policy
InsuranceIntel.us reserves the right to modify, alter, or update this DMCA Policy at any time. Such modifications shall become effective immediately upon posting. Your continued use of the Site following the posting of changes and/or modifications will constitute your acceptance of the revised DMCA Policy.
